I. These Terms and Conditions of Use (“Terms of Use”) govern the use of the LOTTO BALLS platform, made available by JOMAR GAMES LTDA, a private non-profit entity, registered under CNPJ No. 54.836.566/0001-87, headquartered at Praça Nereu Ramos, 90 – SALA DO EMPREENDEDOR – Centro, Biguaçu/SC.

II. The Platform allows the USER to access consolidated data from companies and the Technology Sector of Santa Catarina.

III. LOTTO BALLS will provide free access to the Platform.

IV. LOTTO BALLS is intended for recreational purposes. Our game may include virtual coins, items, or services for use in our Game. To benefit from or use Virtual Content in our Game, you will receive 400 free coins every 24 (twenty-four) hours. Once these are exhausted, you have the option to purchase more coins to gain additional credits and continue playing. YOU AGREE THAT, ONCE PURCHASED, VIRTUAL CONTENT HAS NO MONETARY VALUE AND CAN NEVER BE EXCHANGED FOR REAL MONEY, REAL PRODUCTS, OR REAL SERVICES, WHETHER OURS OR THIRD-PARTIES'. You also agree that Virtual Content is non-transferable to third parties, and you will not transfer or attempt to transfer Virtual Content to others. Your purchase will be completed when our servers validate your purchase, and the Virtual Content is successfully credited to your account on our servers.

V. It is important that YOU read these Terms of Use carefully before using the Platform.

VI. BY USING THE PLATFORM AND SERVICES, YOU VOLUNTARILY DECLARE THAT YOU HAVE READ, ARE AWARE OF, AND AGREE WITH ALL PROVISIONS OF THESE TERMS OF USE. IF YOU DO NOT AGREE WITH ANY CONDITION SET FORTH IN THESE TERMS OF USE, YOU SHOULD NOT USE THE PLATFORM.

VII. By using the Platform, you declare that you have the capacity to license the Platform under the law, either on your own behalf or as a representative of a legal entity.

TERMS OF USE CONDITIONS

1. USER REGISTRATION

.1. To access the Platform, the User must register by creating a user login and password. Upon the first login and registration on the Platform, LOTTO BALLS grants the User a non-exclusive, temporary, non-transferable, and revocable license to use the Platform.

.2. he User declares that the personal information provided at registration is correct, complete, and truthful and agrees to keep all their data updated.

.3. When using our services, you may choose or, in some cases, be required to create an account with us (LOTTO BALLS Account). If you create an account with us, you agree to take all necessary measures to protect your login information and keep it confidential. If you do not create a Lotto Balls Account, your game and any acquired or earned Virtual Content cannot be accessed from any other device and will not be restored to a different device if your device is lost, damaged, or replaced.

.4. After registration, the User will hold a personal account that can only be accessed by the User using their login and password ("Credentials"). If LOTTO BALLS detects any account created with false personal information, the User's registration may be automatically canceled without prior notice, and the User will no longer have access to the Platform. The User will not be entitled to any compensation for this reason. If duplicate accounts are found, LOTTO BALLS may permanently disable the duplicate registrations, regardless of sending any prior communication to the User.

.5. Credentials are individual, and the User is solely responsible for all activities associated with their account on the Platform. Providing access to the Platform to the User's dependents is solely the User's option, and LOTTO BALLS is fully exempt from any responsibility in this regard. If the User grants access to dependents, they must convey all information sent by LOTTO BALLS, especially concerning instructions for using the tools and devices provided.

.6. The User is solely responsible for keeping their Platform access password confidential. You agree not to share your login details with third parties or allow anyone to use your login details or Lotto Balls Account.

.6.1. If the User identifies or suspects any unauthorized use of their Credentials on the Platform, they must immediately contact LOTTO BALLS via email at contact@jomargames.com, describing the situation.

.7. We have the right to assume that any person who logs into your Lotto Balls Account using your login details is you, not someone else. If you fail to keep your login details confidential or share them with third parties (intentionally or unintentionally), you accept full responsibility for the consequences (including any unauthorized purchases) and agree to indemnify us fully for any losses or damages resulting from this.

.8. The data provided during registration will allow LOTTO BALLS to contact the User to send communications related to their account and the Platform. It is the User's responsibility to keep their data up to date. LOTTO BALLS will not be responsible for any events arising from its inability to contact the User due to outdated data.

.9. To complete the registration and access the Platform, LOTTO BALLS may, at any time and at its sole discretion, without prior notice, verify the information provided by the User during registration, and may request additional data and/or documents to verify the User's identity. The User is prohibited from registering on the Platform using third-party information.

2.0 LICENSE AND ACCESS GRANTED TO USER

2.1 We are not responsible for any loss you may suffer from another person accessing your account and using your King Account and/or our Services, nor do we assume any liability for any losses or damages resulting from unauthorized use, whether fraudulent or otherwise.

2.1.1 The requirements for access and use of the Platform by Users may be modified by LOTTO BALLS at any time and for any reason, including but not limited to technological updates. Users agree and acknowledge that failure to meet all system requirements and/or update the device used to access the Platform may affect and/or cancel their access and/or use of the Platform.

2.1.2 Using the Platform contrary to these Terms of Use may result in the suspension or deletion of the User's registration, without prejudice to any civil, criminal, or administrative penalties, including damages through the payment of fines or compensation by the User and those who assisted in violating these Terms of Use.

2.2 Specific Game rules, scoring rules, controls, and guidelines for each Game can be found within the Game itself. Such rules, scoring rules, controls, and guidelines are part of these Terms, and you agree to comply with them regarding the Game you access.

2.3 You are responsible for the internet connection and/or mobile fees you may incur by accessing and/or using our Services. Before accessing and/or using our Services, you should check with your mobile carrier or internet service provider if you have any questions about these fees.

2.4 There may be occasions when our Services, or any part of them, are unavailable due to technical or maintenance reasons, whether scheduled or not.

3. USERS' OBLIGATIONS

3.1 Users commit to, without prejudice to other obligations and responsibilities provided in these Terms of Use:

(a) Use the Platform only for its intended purposes, not using it for any illegal purpose or for purposes that do not meet criteria of truthfulness;

(b) Not use the bots developed through the tools provided by LOTTO BALLS in a malicious manner, for unlawful purposes, and/or contrary to the policies of the browsed environment or Platform;

(c) Not register or transmit any kind of information that is untrue, does not belong to the User, or misleads both LOTTO BALLS and the party to whom the information is directed;

(d) Not violate the privacy of the site and the Platform or other Users;

(e) Not send or transmit files that contain any viruses, worms, malware, or other computer programs that could damage the site or the recipient;

(f) Not use false computer, network, or email addresses;

(g) Not use any device, software, or other resources that may interfere with the activities and operations of the Platform, as well as with the hosting of offers, descriptions, or its databases;

(h) Be responsible for any type of information or statement originating from their Credentials;

(i) Configure their equipment in a way that protects it from potential invasions that may result in the spread of viruses; and

(j) Assume full responsibility for the truthfulness, accuracy, and timeliness of the data entered, recognizing that any false, inaccurate, incomplete, outdated, or incorrect data or information may lead the Platform, as well as the tools and devices provided, to error.

4. INTELLECTUAL PROPERTY

4.1 The licensed Platform, as well as all its components and elements, including new versions and updates, are the exclusive property of LOTTO BALLS. All content available on the Platform, as well as its graphic designs and source codes, are protected by copyright (Laws 9.609/98 and 9.610/98) and are the exclusive property of LOTTO BALLS. For the purposes of interpreting this clause, "content" refers to all functionalities and material made available on the Platform, including designs, texts, graphics, images, videos, information, music, as well as its selection and arrangement.

4.2 Under no circumstances will the User acquire, by these Terms of Use or by using the Platform, any intellectual property rights or other exclusive rights, including patents, designs, trademarks, copyrights, or any rights over confidential information or trade secrets related to the Content available on the Platform, including, but not limited to texts, graphics, images, logos, icons, photographs, editorial content, notifications, software, and any other material related to or available on the Platform or any part of it.

4.3 It is prohibited for the User or third parties, in general:

(a) To copy, assign, sublicense, sell, lease or use as collateral, reproduce, donate, alienate in any way, transfer, in whole or in part, under any modality, free of charge or for consideration, temporarily or permanently, the Platform, as well as its modules, parts, manuals, or any related information;

(b) To disclose to third parties data accessed through the use of the Platform, being these only for the internal and restricted use of the User;

(c) To practice reverse engineering, decompilation, or disassembly of the Platform;

(d) To copy, distribute, transmit, publish, or in any other way modify the content of the Platform.

4.4 Users may not use the trademarks, trade names, corporate names, logos, slogans, or any other distinguishing signs related to LOTTO BALLS and/or owned by LOTTO BALLS without prior express authorization from LOTTO BALLS.

4.5 Any violation of the provisions of this chapter shall constitute an infringement of the intellectual property rights of LOTTO BALLS and shall subject the User or the infringing third party to applicable administrative, civil, and criminal sanctions.

5. CANCELLATION

5.1 If the User wishes to cancel the license contract for the Platform, they may do so at any time by sending an email to the following address: contact@jomargames.com.

5.2 The cancellation will be processed within 5 (five) business days after its confirmation, either through the Platform or by email, deactivating the User's registration.

6. DATA PROTECTION

6.1 LOTTO BALLS is committed to preserving and protecting your privacy and your data. Under these Terms of Use, Users agree to comply with the General Data Protection Law (Law No. 13,709/19 – “LGPD”), as well as any other legislation that may apply to the use of the Platform and/or the activities of the User.

6.2 Users can access LOTTO BALLS' Privacy Policy at this link, the full content of which is considered an integral part of these Terms of Use.

6.3 LOTTO BALLS is not responsible for the use of its Platform by Users for purposes that may violate the provisions of the LGPD or any other applicable data protection legislation.

7. RESPONSIBILITY

7.1 IN VIEW OF THE INHERENT CHARACTERISTICS OF THE INTERNET ENVIRONMENT, LOTTO BALLS IS NOT RESPONSIBLE FOR ACCESS OR NAVIGATION FAILURES ON THE PLATFORM ARISING FROM CIRCUMSTANCES BEYOND ITS WILL AND CONTROL, SUCH AS INTERRUPTIONS OR SUSPENSIONS OF CONNECTION, INCOMPLETE OR FAILED COMPUTER TRANSMISSIONS, AS WELL AS TECHNICAL FAILURES OF ANY NATURE, INCLUDING, WITHOUT LIMITATION, THE MALFUNCTIONING OF ANY NETWORK, HARDWARE OR SOFTWARE OF THE USER OR THIRD PARTIES, FAILURES IN THE INTERNET IN GENERAL, POWER OUTAGES, MALFUNCTIONING ELECTRONIC AND/OR PHYSICAL OF ANY TELECOMMUNICATIONS NETWORK. THE UNAVAILABILITY OF ACCESS TO THE INTERNET AND THE PLATFORM (IN THIS LAST CASE, INCLUDING CASES OF EMERGENCY OR SCHEDULED INTERRUPTIONS FOR MAINTENANCE, UPDATES, AND CONFIGURATION ADJUSTMENTS OF THE PLATFORM), AS WELL AS ANY INCORRECT OR INCOMPLETE INFORMATION PROVIDED BY YOU ON THE PLATFORM, AS WELL AS ANY HUMAN, TECHNICAL, OR ANY OTHER TYPE OF ERROR IN PROCESSING INFORMATION, WILL NOT BE CONSIDERED RESPONSIBILITY OF LOTTO BALLS. IN THIS SENSE, LOTTO BALLS DISCLAIMS ANY RESPONSIBILITY ARISING FROM SUCH FACTS AND/OR ACTS.

7.2 CONSIDERING THE FREE NATURE OF THE LICENSE GRANTED FOR THE USE OF THE PLATFORM, LOTTO BALLS WILL NOT BE HELD RESPONSIBLE TO ANY USER OR THIRD PARTIES FOR ANY DIRECT OR INDIRECT LOSSES OR DAMAGES (INCLUDING LOST PROFITS AND NON-PATRIMONIAL DAMAGES) DUE TO THE USE OF THE PLATFORM OR THE USE OF DATA ACCESSED THROUGH THE PLATFORM.

7.3 Still due to the free access, LOTTO BALLS reserves the right, at its discretion and at any time, to change or remove functionalities and content from the Platform, in whole or in part, without prior notice to the User, and without any compensation being owed to the User. LOTTO BALLS may also terminate, at its sole discretion, the availability of the Platform. In this case, the User will be notified in advance.

8. AGE

8.1 According to our Terms of Use, you must be of a certain age to play our Game and use our Services, depending on where you live. We do not knowingly collect or solicit personal information or target interest-based advertising to individuals under the following minimum ages (or 16 years for residents of the United States).

8.2 Opening an account on the LOTTO BALLS platform will not be allowed for:

8.2.1 Children: any user under the age of 13. If you are a parent or guardian of a child aged 13 or older (depending on the applicable laws of your country), you agree to these Terms on your behalf and on behalf of the child(ren) you authorized to use the Service in accordance with these Terms. 8.2.2 Minor: a user of the services who is a minor in their jurisdiction or state of residence.

8.3 YOU ARE AND HEREBY CONFIRM THAT YOU ARE AN ADULT OF LEGAL AGE IN YOUR COUNTRY OR STATE OF RESIDENCE. If you are over 13 years old but have not reached the legal age of majority, one of your parents or your legal guardian must consent to these Terms as set forth in paragraph 8.2.1.

9. FINAL PROVISIONS

9.1 The User who violates these Terms of Use will be notified to cease the irregular practice, within a period to be determined by LOTTO BALLS, without prejudice to any legal consequences that such irregularities may cause.

9.2 Non-compliance with these Terms of Use authorizes LOTTO BALLS to cancel, suspend, delete, and/or deactivate the User's registration, temporarily or permanently, at its sole discretion, without prejudice to relevant legal consequences and without the need to notify the User of the action taken within its system.

9.3 LOTTO BALLS may assign the rights and obligations relating to these Terms of Use to third parties without any notification being due to the User.

9.4 Communications between the parties may be made by registered correspondence, email, or through electronic messaging on the Platform. If the User needs to contact LOTTO BALLS, they must do so via email at contact@jomargames.com.

10. LEGISLATION AND JURISDICTION

10.1 These Terms of Use are governed by the laws of the Federative Republic of Brazil.

10.2 The Central Court of the Capital of the State of Santa Catarina is elected as competent to resolve any disputes arising from these Terms of Use, regardless of any other, no matter how privileged it may be or may become.

10.3 This Term will be considered concluded and binding between LOTTO BALLS and the User at the moment the User completes their registration and the procedure provided on the Platform, being certain that, by proceeding in this manner, the User declares having read and understood all the terms and conditions of this Term
